HOUSE BILL NO. 33

AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO THE REGISTRATION OF SEX OFFENDERS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Subsection (a), Section 4121, Title 11 of the Delaware Code by adding, immediately after the second sentence of paragraph (1), the following new sentence:

"Notwithstanding the methods of notification previously set forth herein, the President, Mayor, or other highest officer of each county, municipality and town within the State shall receive the notification required by this subsection.".

SYNOPSIS

When a sex offender is released from custody, the State Police or local police agency provides "community notice" to the public in accordance with §4121(a), Title 11 of the Delaware Code. That section requires notice by various methods to "members of the public" in general, and to schools in particular. This Act provides that counties, municipalities and towns shall also receive community notice concerning sex offenders.
